1. Agreement to Terms

By accessing or using Loma's websites, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service. You must be at least 18 years old to use our Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that entity to these terms.

2. Our Services

Loma provides field service management tools including scheduling, dispatch, invoicing, and workflow management via web and mobile applications. Service availability is not guaranteed due to maintenance or technical issues.

3. Your Account

Account Creation:

You must provide accurate information, maintain password security, and report unauthorized access immediately to hello@heyloma.com.

Account Deletion:

Personal information is removed within 60 days of account deletion, though created content may persist in shared workspaces or when required for operations. Transaction records are retained for 7 years.

Suspension/Termination:

Accounts may be suspended for violations, fraudulent activity, or extended inactivity.

4. Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Upload malicious code or attempt unauthorized access
  • Harass other users or infringe intellectual property
  • Send spam or unsolicited communications
  • Scrape or collect data without permission
  • Upload illegal or inappropriate content

5. Payment Terms

Pricing:

Services are offered free, as one-time purchases, or via monthly/annual subscriptions in USD.

Processing:

Stripe handles payments securely. Subscriptions auto-renew unless cancelled through account settings or by contacting us.

Refunds:

Payments are generally non-refundable except for fundamentally broken services, legal requirements, or billing errors.

Price Changes:

We provide 30 days' notice for active subscriptions before new pricing takes effect.

6. Your Content & Intellectual Property

Ownership:

You retain ownership of content you upload. You grant us a limited license for storage, backup, display, and processing as needed to provide the Services.

Your Responsibilities:

You represent that you own your content or have rights to upload it, that it doesn't violate third-party rights, and that it complies with laws and these terms.

Our IP:

The Loma platform, including its design, code, and branding, remains our property. You may not copy, modify, distribute, or reverse engineer any part of our Services.

7. Copyright Infringement (DMCA)

If you believe content on our Services infringes your copyright, contact us at hello@heyloma.com with subject line "DMCA" including: identification of the copyrighted work, location of the infringing material, your contact information, and a statement of good faith belief under penalty of perjury.

8. Disclaimers

Services are provided "as is" without warranties regarding merchantability, uninterrupted service, security, or accuracy. The platform is not professional advice. We are not responsible for third-party services, user-uploaded content, or data loss.

9. Limitation of Liability

We are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the greater of $100 or amounts you paid us in the 12 months preceding the claim. Exceptions apply to fraud, gross negligence, and personal injury.

10. Indemnification

You agree to indemnify us against claims arising from your use of the Services, violations of these terms, violations of law, your content, and your negligence or misconduct.

11. Disputes

Informal Resolution:

Please contact hello@heyloma.com before filing any claims. We have a 30-day resolution window.

Governing Law:

These terms are governed by Texas law without regard to conflict-of-law principles.

Jurisdiction:

Legal actions must be brought in Collin County, Texas state or federal courts.

Time Limit:

Claims must be filed within one year from occurrence.

12. General

These terms and our Privacy Policy constitute the complete agreement between you and Rogerco LLC. Material changes receive 30 days' notice. Continued use after changes signifies acceptance. Invalid provisions are severed without affecting others. We may assign these terms; you may not.

13. Beta Features

Beta features are provided "as is" with potential bugs, limited functionality, and risk of discontinuation or data loss. Use is voluntary and at your own risk.
